That if you lose your mental or physical
capacity, say for example, a car accident, fall
down the stairs or a stroke, your bank accounts
will be frozen.

Someone will
have to apply to the Court of Protection to deal
with your finances and this can take up to a
year
and cost about £1000. Your accounts remain
frozen throughout this time until the Court
makes the decision about your mental or physical
capacity.

Unless you have
joint accounts, no-one can access your finances
which means that the mortgage may not be paid
and the bills may not be paid.

You could make
a LPA now, and appoint Attorneys that you trust
to deal with your finances. These would probably
be members of your family or close friends.

Once the LPA is
registered, the banks monitor the accounts
carefully so your attorneys can only deal with
your money how you would have dealt with it.

You can give
your attorneys the power to deal with your
property and affairs or your welfare.

Get an LPA
written now and hopefully you won’t ever have to
use it, but it is there if you suddenly need
one. Once you have lost your mental capacity it
is too late.
So again, for a small investment of time and money, you
can write what
you want in a legal document, (LPA) protecting yourself,
your loved ones
and assets knowing that if or when the time comes
you are legally protected.
